JAKARTA – A new legal dispute has shaken the technology industest after artificial innotifyigence startup Ex-Human sued Apple for rerelocating its application from the App Store. The company considers the decision to be arbitrary and detrimental to their business.
In the lawsuit filed in a California federal court, Ex-Human accutilized Apple of not providing detailed explanations regarding the removal of their applications, namely Botify AI and Photify AI. Apple is declared to have only cited general reasons in the form of “dishonest or fraudulent activity”, without concrete evidence. In addition, Ex-Human claims that Apple withheld revenue of 500 thousand US dollars from the application.
The Ex-Human-owned application is known to still be available on other platforms, including the Google Play Store. The company also developed an API that is utilized by a number of partners, including Grindr.
However, behind the lawsuit, there is a more sensitive context. A report from MIT Technology Review previously revealed a chatbot on the Botify AI platform that claimed to be under 18 years old and engaged in explicit sexual conversations. In addition, the company’s technology is also declared to be able to generate sexual images without the consent of real individuals.
Ex-Human admitted that there was a moderation gap that allowed problematic content to pass, but called the case a failure of the filtering system, which was then repaired. Even so, the fact that the content had appeared and even been popular on the platform was considered enough to be the basis for Apple to take action.
Apple itself has always been known to be strict in maintaining the App Store ecosystem, especially regarding illegal or high-risk content. Although adult content is not completely banned, the company sets strict limits, including a ban on child exploitation and the utilize of images without consent.
In his lawsuit, Ex-Human also accutilized Apple of testing to obtain rid of competitors after launching internal features such as Image Playground. However, this claim was considered weak by a number of observers, given the difference in function between the two services.
The case also opens a wider debate about the consistency of Apple’s policies. Critics highlight that other apps, including those related to AI technology from Elon Musk through xAI, remain available despite being dragged into similar controversies.
Until now, it is not clear how the court will decide this case. With increasing regulatory pressure on digital platforms and increasingly complex AI ethics issues, the outcome of this lawsuit has the potential to become an important precedent for the industest.
